Platform AvailabilityOrb by PositiveAI is currently available on iOS (iPhone, iPad, iPod touch) through the Apple App Store. Android and web versions are coming soon, and these Terms will be updated accordingly when new platforms launch.System Requirements:
- iOS 15.0 or later for current version
- Internet connection for cloud sync (full accounts only)
- Push notification permissions for daily reminders (optional but recommended)---## 3. Account Types### 3.1 Anonymous AccountsWhen you first install the app, you're automatically assigned an anonymous account with local data persistence only.Anonymous accounts:
- Do not require email or personal information
- Store data locally on your device only
- Cannot sync across multiple devices
- Are lost if you delete the app without upgrading to a full account### 3.2 Full AccountsYou may upgrade to a full account by signing in with Apple or Google.Full accounts:
- Enable cloud synchronization across devices
- Allow account recovery if you switch devices
- Are required for Premium subscription tier
- Back up your progress, mood data, and history to the cloudBy creating a full account, you agree that the information provided through your sign-in provider (Apple or Google) is accurate and current. You are responsible for maintaining the security of your account credentials.---## 4. How the Service Works### 4.1 Daily Check-InsThe Service is built around two daily check-ins (also called "anchors") that structure your day:Morning Check-In:
- Available from 4:00 AM until 12:00 PM (noon) local time
- Must be completed before evening check-in becomes available
- Missing the noon deadline results in regression (moving back one day)Evening Check-In:
- Available from 5:00 PM until 4:00 AM (next day) local time
- Only becomes available if morning check-in was completed
- Unlocks on Day 3 and beyond (Days 1-2 only require morning check-in)
- Missing this check-in results in regression### 4.2 Daily Reset TimeAll days advance and reset at 4:00 AM local time. At this time:
- New days begin if the previous day was completed successfully
- Frozen days unfreeze for a fresh attempt
- Check-in windows reset
- Previous day's incomplete check-ins can no longer be completedThe Service uses your device's timezone to determine the 4:00 AM boundary. When traveling across timezones, the app adjusts automatically within 24 hours.### 4.3 Progression SystemAttempting Days:
When attempting a new day, missing a check-in causes regression—you move back one day (e.g., attempting Day 16 → Day 15). The day becomes "frozen" until the 4:00 AM reset.Holding Days (Non-Milestone):
When maintaining a non-milestone day you've already earned (e.g., Days 2-6, 8-13, 15-29, etc.), missing a check-in causes regression to the previous milestone:
- Holding Day 15 → Miss → Day 14 (previous milestone)
- Holding Day 8 → Miss → Day 7 (previous milestone)
- Holding Day 4 → Miss → Day 1 (previous milestone)Milestone Days:
Days 1, 7, 14, 30, 60, and 90 are milestone days with special protections:
- You receive a grace period of 2 missed check-ins
- On the first miss, you stay on the milestone with 1 grace remaining
- On the second miss, you stay on the milestone with 0 grace remaining
- On the third miss, regression occurs to the previous milestone
- Grace counters reset once you successfully complete the milestone and advanceFrozen Days:
When a check-in is missed, that day becomes frozen:
- No further check-ins are available for the remainder of that day
- No additional regression can occur (protection against cascade failures)
- At 4:00 AM, the day unfreezes for a fresh attempt at the regressed day numberYou acknowledge and agree that the progression system, including regression mechanics and frozen states, is an intentional design feature of the Service meant to encourage daily consistency.---## 5. Feature DefinitionsTo ensure clarity, the following terms have specific meanings within the Service:Orb / Visual Progress Tracker:
The interactive visual display that represents your current progress state and evolves visually as you advance through milestones.Anchors / Daily Check-Ins:
The two required touchpoints each day (morning and evening) that you must complete to maintain progress and avoid regression.Fusion / Peer Matching:
The feature that connects you with another active user for temporary, anonymous mutual support through ephemeral chat.Companions / Milestone Markers:
Visual indicators that appear at Days 14, 30, 60, and 90 to represent major milestone achievements.---## 6. Subscription Tiers & BillingThe Service offers two subscription tiers. A subscription is required to access most features beyond any initial trial period.### 6.1 Standard Subscription
£5.99/month or £59.99/yearIncludes:
- Full access to daily check-in system
- Visual progress tracker with milestone evolution
- Grace period system at milestones
- Peer matching (Fusion) feature
- Mood tracking at milestones

- Cloud sync (requires full account)
- Push notifications### 6.2 Premium Subscription
£8.99/month or £89.99/yearIncludes everything in Standard, plus:
- AI coaching chat powered by Claude
- Personalized insights based on your patterns

- Priority customer support### 6.3 Billing Terms- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Payment is charged to your Apple ID account upon purchase confirmation
- Subscriptions are managed through your Apple ID account settings, not within the app
- Prices are in GBP (British Pounds) and may vary by region
- Annual subscriptions offer 17% savings compared to monthly billing
- No refunds are provided for partial subscription periods
- Free trials (if offered) convert to paid subscriptions unless cancelled before the trial endsTo cancel your subscription, go to your device's Settings → [Your Name] → Subscriptions, select Orb, and tap "Cancel Subscription."---## 7. User Conduct### 7.1 General ConductYou agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable local, national, or international law
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Use automated systems (bots, scripts) to access or interact with the Service
- Create multiple accounts to bypass restrictions or manipulate the Service
- Reverse engineer, decompile, or disassemble any aspect of the Service### 7.2 Peer Matching (Fusion) ConductThe Fusion feature is restricted to users 18 years of age or older due to the anonymous peer-to-peer nature of the temporary chats.When using Fusion:
- Chats are ephemeral and automatically delete when either user leaves
- No message history is retained
- Content moderation is performed via AI safety screening
- Violations result in immediate termination of the session and potential account suspension or ban
- Users can report inappropriate behavior, which triggers immediate reviewZero-tolerance policies apply to:
- Harassment, bullying, or threatening behavior
- Sexual content, advances, or solicitation
- Hate speech or discriminatory content based on race, religion, gender, sexual orientation, disability, or other protected characteristics
- Spam or commercial solicitation
- Sharing of illegal content or engagement in illegal activity
- Impersonation or misrepresentationViolations may result in immediate and permanent ban from the Service without refund.### 7.3 AI Coaching Conduct (Premium Only)When using AI coaching features:
- Do not share personal information of others
- Do not attempt to manipulate or "jailbreak" the AI
- Do not use the AI for illegal purposes or to generate harmful content
- Understand that AI responses are generated by third-party services (Anthropic Claude) and may not always be accurate---## 8. Intellectual Property### 8.1 Our RightsThe Service, including all content, features, functionality, visual designs, code, and user interface, is owned by PositiveAI and protected by international copyright, trademark, and other intellectual property laws.You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.### 8.2 Your ContentWhen you use the Service, you may create or submit content such as:
- Mood tracking entries
- Chat messages in Fusion sessions
- AI coaching conversations (Premium only)You retain ownership of any content you submit. By submitting content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.Important: Fusion chat messages are ephemeral and automatically deleted when either user leaves. - Device and usage analyticsAnonymous accounts store data locally. Full accounts sync data to the cloud via Firebase.### 10.2 Data Retention- Active accounts: Data retained indefinitely while account is active
- Fusion match records: Automatically deleted after 30 days
- Fusion chat messages: Immediately deleted when either user leaves the session
- AI coaching history: Retained indefinitely for Premium subscribers for conversation continuity

Account Deletion### 11.1 Deletion ProcessYou may request account deletion at any time through the app (Settings → Account → Delete Account).When you request deletion:
1. Your account enters a 7-day grace period during which you can still access the app and cancel the deletion
2. After 7 days, your account and all associated data are permanently deleted from our servers
3. Active subscriptions must be cancelled separately through App Store settings (we cannot cancel or refund active subscriptions)Anonymous accounts can be deleted instantly by uninstalling the app, as no cloud data exists.### 11.2 What Gets Deleted- Cloud-stored user profile and authentication data

- Non-payment of subscription fees
- Suspected fraud or security concerns
